Can a sex change end your marriage – legally?

When considering a sex change, the legal status of your marriage is probably the last thing on your mind. But the relationship with your wife, as defined by the everyday loving interactions you two share, is something that goes through your mind throughout the day. As is the relationships you have with family, friends and co-workers. Between the myriad of doctors and psychologists and huge life upheavals, you may have missed the legal consequences for becoming a member of the fairer sex.

As a recent New York Times article shares – there aren’t any. That’s right, the transgendered have found a way to get around the bigotry which surrounds same sex marriage – albeit through a less traditional means.

28 years ago Donald Brunner married Frances Gottschalk, but after a sex change operation in 2005 Donald became Denise. His loving wife Fran stuck by her, and they had their marriage certificate amended.

While they have the piece of paper, the Brunner’s are still filled with angst over the legal status of their marriage. What does the IRS think? What would happened in the event of an accident? So far they haven’t had any trouble from government employees, but largely because the patchwork of government laws doesn’t adequately address this case. The article cites a bizarre conundrum:

Urging the United States Supreme Court to tackle the issue in 2000, lawyers for Christie Lee Littleton, a Texas male-to-female transsexual suing her husband’s doctors for wrongful death, noted the confused landscape: “Taking this situation to its logical conclusion, Mrs. Littleton, while in San Antonio, Texas, is a male and has a void marriage; as she travels to Houston, Texas, and enters federal property, she is female and a widow; upon traveling to Kentucky she is female and a widow; but, upon entering Ohio, she is once again male and prohibited from marriage; entering Connecticut, she is again female and may marry; if her travel takes her north to Vermont, she is male and may marry a female; if instead she travels south to New Jersey, she may marry a male.”

The Supreme Court declined to take the case.

Another quote from Robyn, who married before having a sex change and still with her wife:

“We always worry about the day someone does question our situation,” Robyn, 55, said. “All it takes is some right-wing people, and there’s no way to know where the court is going to rule.”

As Hilzoy writes – imagine losing your kids because a court decided your marriage no longer counted. Even after 25 years. Imagine living in fear every day, because you’re different. Yet people like Mathew Staver of the Liberty Counsel rail against human liberties when he says ‘What you’re born with is what you are’. Intending to disparage transsexuals, yet ironically many would say they are born as a woman trapped inside a man’s body. So perhaps he’s right…

Already the blogosphere has lit up, with many using this as a rallying cry to ‘just up and let us marry whomever we please‘.

One thing I do know – while our legal system may make it difficult to stay together, it cannot stop two people from loving each other.

Another country on the side of transgender justice

It may feel like there are times when we don’t have much to cheer about in our legal process. Transgender protections have been removed from ENDA (employment non-discrimination act) and it seems that even Democrats and the human rights commission has abandoned us.

Yet inspite of transphobia justice seems to prevail. Recently Broward County in Florida added transgender protections to the county’s anti-discrimination laws. Protecting gender identity, appearance and expression. In a previous article I mentioned that the way to win equal transgender rights was city by city, person by person. Taking them from surprise and fear to familiarity. I believe that’s how it’s going to happen. As each city and county signs laws that protect us, we will enter the national arena with a large core of support from across the country.

I love posting about these steps forward for justice and freedom. I know there are many who are afraid, many who have been treated unfairly, denied employment and opportunities. I think we should all celebrate whenever our brothers and sisters are sparred this fate.

Pass as a genetic woman

I felt I had to write that in large font. In my mind I hear those words echoing like the booming voice of a fake god on a cheesy television show. As if passing is a judgement we must face, a test we must pass or face the crossdressing shame of ridicule.

Okay, enough melodrama for one post. I was thinking about some woman who go further, perhaps permanently or semi-permanently altering their appearance. To put forth a more convincing feminine appearance, or perhaps to feel the luscious covering of feminine silkiness throughout the day.

Personally, I have pierced my ears, and have had laser hair removal on my face and most of my body. I used to wear my hair long, before my wife lovingly convinced me that she preferred to see me as a man every once in a while :) Same story with my nails, though to tell you the truth once they got much longer than a quarter inch it became tough to do everything things as easily. I get my eyebrows waxed on a fairly regular basis in a high arching feminine style, and make sure to moisturize regularly.

That’s a few of the things I do to go ‘above and beyond’. I don’t take hormones, which would probably help my femininity even more. I try to incorporate feminine movement and voice tips, such as those in this crossdressing how to, though I’m not as diligent as I could be.

Cross Dresser Wrecks Lingerie store – Embarrasses us all

Congratulations go to Jeremy Paul McIntosh for running his car into a lingerie store and managing to do $3000 worth of damage and embarrass the transgender community. Yes, this recent revenge driven incident has caused some to comment “So, what were they saying about transvestitism and transsexualism not being mental illnesses?

And it’s with every rights that they do so. Being denied a job does not give you the right to endanger lives and destroy property.

Naturally all the hard working, upstanding cross dressers and transgender folks don’t make the news – as normal never does. Yet for a few weeks the blogosphere and newslines will be abuzz with the latest story of the crazy cross dresser. Just as they were a few months back about the crazy Australian transsexual.

I’m disappointed. Gender issues are difficult enough to explain to those who are not transgendered. Transgender is still classified by the DSM (the diagnostic and statistical manual of mental disorders) as a mental disorder, and by acting in such a manner people like Jeremy only affirm society’s view of us – that we’re crazy. Whether we like it or not, we are at a period in history where being accepted as transgender still requires that we show ourselves to be beyond reproach. Or at the very least, regular hard working people who contribute to their community.

Ladies, gentlemen and in between – I’m going to try an experiment to see whether I can put a poll on cross dresser heaven and have everything work.
